Well aware of the character models, but it is exactly what ggctuk said. The U-wing and Tie Striker are roughly 6500 Polys and are pretty nice in detail, the u-wing is a lot nicer than the one I am using.

The spirit of the rule is that if a sufficient community asset doesn't exist then to go to the games. So if the U-Wing is that much better, or if the community model doesn't suffice, then it's cleared.

I do not want to ask when it comes to EA's Battlefront (2015) but I have to ask anyway. When it comes to sounds I am clearly sure we are not allowed to rip/extract audio files from this game. Not even for one simple fire sound. That's understandable. But what about recorded sounds (Let's say: minimal use of particular weapon sounds) from gameplay videos found on YT? Or recorded in-game? I remember it was allowed to create textures using screenshots from the game, wasn't it? So...wouldn't that apply to sounds to, at least?

I'll have to say a very firm no. It's the same principle, and people have been really trying to push that EA envelope lately. I get that people have a desire to be as close to canon as possible, to be super HD, or to have super accurate sounds, but we've survived this long without all this extra stuff.

Most of the sounds can be recreated using older sound banks. I would say that sometimes EA sounds, while sounding pristine, aren't always 'accurate' anyway (I really don't like the E-11 firing sound - hence why I chose to use a different one mixed from EAW and the long-defunct Soundbank on the Star Wars site - and the A280 sound in the stock game is technically accurate already - the EA sound is just a 'bump' followed by the same sound used for laser bolt flyby in TESB). The only sound I've had trouble finding any sound in proximity to is the T21, but I'm fairly sure there must be some substitute out there (the sound is like a pitched-down version of the Droid Fighter firing sound)

So i've done a fair bit of research into this lately to make sure I have my bases covered for what can and cannot be used.

First, to the moderators: this post is not intended to be junior moderating. I'm posting this strictly for information regarding what, from a legal stand point we are and are not allowed to be using.

This information is provided with the intention of having a nice clean and clear list of what assets are usable, rippable and what is off limits based on terms of service and EULA information provided, and based on what companies will and will not allow us use of their assets.

So first:

Lets get a clear understanding of EULA as disney has reworked them for steam, Now under section 3 we see "USER GENERATED CONTENT"

The Disney Services may allow you to communicate, submit, upload or otherwise make available text, images, audio, video, competition entries or other content (“User Generated Content”), which may be accessible and viewable by the public. Access to these features may be subject to age restrictions. You may not submit or upload User Generated Content that is defamatory, harassing, threatening, bigoted, hateful, violent, vulgar, obscene, pornographic, or otherwise offensive or that harms or can reasonably be expected to harm any person or entity, whether or not such material is protected by law.

Basically under user generated content, Disney has given us permission here to take screenshots, text, audio recordings, videos, or "other user generated content" (mods), for the game in which this has covered. An important note here is that, A EULA only covers the software it is written for or the software included in its statement or bundle. (for example KOTOR 1 will have an EULA that covers user generated content for KOTOR and DISNEY services, but this EULA does not cover Battlefront EA).

Now under the presumption from this rule that an EULA is exclusive to the content included in only its statement and the software included inside the sections of the EULA. We can operate under the rule that:

To the extent that we authorize you to create, post, upload, distribute, publicly display or publicly perform User Generated Content that requires the use of our copyrighted works, we grant you a non-exclusive license to create a derivative work using our copyrighted works as required for the purpose of creating the materials, provided that such license shall be conditioned upon your assignment to us of all rights in the work you create. If such rights are not assigned to us, your license to create derivative works using our copyrighted works shall be null and void.

Now this rule of Disney's EULA means under this rule that, we are given the right to use copyrighted works, which since a EULA covers only the software included in its statement, copyrighted material means, the games assets, or pictures from the game ect ect. (if you have agreed to the EULA from KOTOR it does not mean you can take material from FORCE ARENA because the EULA does not actually give you permission for this copyrighted work).

So now what about photos from movies, audio from movies, music and other copyrighted material from disney? They gave us permission right?
very very wrong.

Disney in this EULA has given us permission to use the copyrighted material however, this again extends only to the software for which it is written, if we examine the back of any movie you will find :

This product (including its soundtrack) is authorized for sale in [countries list here]. This product is authorized for private use only. All other rights reserved. Unless expressly authorized in writing by the copyright owner, any copying, exhibition, export, distribution or other use of this product or any part of it is strictly prohibited. Refer to the inner ring of the disc for manufacturing information

You will find a similair notice on the back of sound tracks and CD's... so this means, sounds, videos, music from the movies is forbidden from us using and ripping without exclusive permission from the copyright holder in writing. Does this mean we can use it since its disneys? NO. because an EULA from software is exclusive to its components or the components for which it is written we do not have disneys permission.

now what about photos? photos are entirely dependant on the source, if you look at a photo from a website many of them will have additional copyright information, and in many cases you actually have permission to use or redistribute. Always check the terms of use before using any photos, and always check to make sure you have permission to redistribute (even a packed and munged .lvl is considered distributing)

Now along with that: Disney's EULA does cover, and grants us permission to use content from: (and most affiliated sites)

Now along with that even if a game no longer is available, being distributed, or is not making money several games have a provision against reverse engineering or using their content, and therefor we are not allowed to rip or use their assets.

So that completes our list as to what we can and cannot use and what is available for us.

I realize the community has a different set of rules for this, but from a legal stand point and from following the EULA provided these are the games we are and are not allowed to use things from. These are the sources we are or are not allowed to use things from.

If you see something in the list that is incorrect or infact has a provision to allow us to use it please correct me. It's been a long weekend of reading through EULA / DMCA /TOS... But atleast now we have a bit of a list of what is and is not legally allowed.

[edit] should also probably say that from a legal stand point this list was compiled, this does not necessarily gaurentee you CAN rip them this is just to the best of my knowledge what is allowed. Any time you take an asset from a game to convert it to another game you do so at your own risk and you are liable for your own actions.
Game toast also has its own site rules which say to or not to use certain assets; and all though this list says what is legally allowed it does not cover what this site itself allows.

great to have a (fully) complete list. Can you maybe make the allowed things green and the not allowed red?? i think that would make it more readable.

Huh. I just read through that list. We were banned from using Pinball assets before. I didn't realise that it had Disney's EULA attached to it, which is neat, because it means I can use the AT-ACT and the DT-29 from there (looking at the DT-29, it would be very, very diffuclt for me to make that weapon from scratch because of the position the official still is in: the scope blocks parts of the gun).

I also didn't realise the LEGO Star Wars games all had that EULA either. Of course, if I were to use anything from there, I'd not use the LEGO stuff (what with LEGO itself being copyrighted to the LEGO company) but that means we can use things like environments and sounds.
